How is porn not concidered prostitution?

The legal fiction is that Pornography is a form of art. The actors in the movie are paid for their performance not the act of having sex. Not in California, I read that all actors in such a video must sign and acknowledgement that they are being paid for the recording of a sexual performance but not for having sex.
